Citing Part 419(5) of the Corporations Act 2013, Patra mentioned, “The scope of Part 419(5) could be very restricted. If there’s a differing view, then that differing view must be taken up by one other member or different members. It doesn’t empower the NCLT below the IBC or firm regulation to kind a five-member Bench.”

He additionally questioned the authority below which the bench stayed solely the August 25 opinion of NCLT Judicial Member Nilesh Sharma.

Disputing this, Patra argued that Judicial Members Ashok Kumar Bhardwaj and Nilesh Sharma favoured approval of the compensation plan and agreed on the eligibility difficulty below Part 79 of the Insolvency and Chapter Code (IBC).

He added that they differed primarily over how the dissenting collectors have been to be handled. Bhardwaj proposed the plan ought to function towards collectors who supported it and may enable dissenting lenders to pursue different cures for restoration.

Sharma, nonetheless, held the plan would bind all collectors, no matter whether or not they agree or disagree, below Part 115 of the IBC.

SG Mehta initially sought to withdraw the lenders’ appeals with liberty to revive them if required. He argued that the appeals may not want rapid consideration after the 5-member NCLT bench stayed Sharma’s opinion and determined to listen to the matter afresh.

Patra opposed the withdrawal with liberty to revive, arguing that the appeals have been faulty as Sharma’s opinion had by no means crystallised right into a ultimate NCLT order.

Mehta subsequently determined to not press the withdrawal functions and as a substitute sought to maintain the appeals pending. The NCLAT agreed and listed the matter for October 7.
