The Reserve Financial institution of India (RBI) on Tuesday launched the draft Overseas Alternate Administration (Overseas Funding) Guidelines, 2026. It has proposed a complete overhaul of the regulatory framework governing overseas funding into India.

The central financial institution has invited feedback from stakeholders till August 31, 2026 earlier than finalising the foundations.

The Union Price range 2026-27 had introduced a complete assessment of the present Overseas Alternate Administration (Non-Debt Devices) Guidelines, 2019 (NDI Guidelines) to create a extra up to date and user-friendly framework for overseas investments.

“Overseas funding into India is presently ruled by the Overseas Alternate Administration (Non-Debt Devices) Guidelines, 2019 (‘NDI Guidelines’). The Union Price range 2026-27 introduced a complete assessment of the NDI Guidelines to create a extra up to date, user-friendly framework for overseas investments, in step with India’s evolving financial priorities,” the financial institution regulator stated in a press release.

Committee Reviewed Present Framework

The RBI stated the Central Authorities had constituted a committee to undertake a complete assessment of the present regulatory framework.

“Pursuant thereto, a committee was constituted by the Central Authorities to undertake a complete assessment of the extant regulatory framework. Based mostly on the suggestions of the Committee, and in session with the Central Authorities and different stakeholders, the Reserve Financial institution of India has ready a draft of the rationalized Guidelines,” it stated.

Key Options Of The Proposed Guidelines

In accordance with the RBI, the proposed framework seeks to simplify rules whereas making them extra clear and aligned with evolving enterprise practices.

Among the many key modifications proposed are:

Simplified, principle-based framework: Rationalisation of provisions, harmonisation of definitions and a simplified regulatory structure to enhance readability and scale back regulatory complexity.

Alignment with the FDI Coverage: A clearer separation between procedural FEMA provisions and coverage or sector-specific necessities to enhance regulatory coherence and allow faster coverage modifications.

Better ease of doing enterprise: Streamlined procedures, decrease compliance burden and higher operational flexibility via a clear and investor-friendly framework.

Future-ready rules: Adoption of principle-based, investee-neutral and investor-neutral provisions aligned with evolving enterprise practices whereas retaining needed regulatory safeguards.

Public session open until August 31

The RBI stated the draft guidelines have been positioned on its web site for wider public session and can be finalised after contemplating stakeholder suggestions.

“The Guidelines can be finalized after wider public consultations. Accordingly, the Reserve Financial institution of India has right this moment positioned on its web site draft Overseas Alternate Administration (Overseas Funding) Guidelines, 2026 for feedback / suggestions from all stakeholders,” it stated.

Stakeholders can submit their feedback via the ‘Join 2 Regulate’ part on the RBI’s web site or by way of electronic mail by August 31, 2026, with the topic line “Suggestions on Draft Overseas Funding Guidelines.”
